Appeal Court Upholds High Court Ruling That Invalidated Outcome Of 2025 Ibadan PDP Convention

The Court of Appeal, Abuja has upheld the decision of the Federal High Court, Abuja to restrain the Independent National Electoral Commission (INEC) from recognizing the outcome of the national convention held by PDP in Ibadan, Oyo State between November 15 and November 16, 2025.

Team@orientactualmags.com learned that the Court of Appeal in a unanimous decision delivered by a three-member panel headed by Justice Uchechukwu Onyemenam dismissed an appeal filed by the National Working Committee produced by the Ibadan convention which is headed former Minister of Special Duties, Alhaji Kabiru Turaki.

They had challenged the jurisdiction of the lower court to entertain the suit.

The Court of Appeal affirmed that the Federal High Court has jurisdiction to hear the suit adding that the dispute was not merely an internal affair of the party.

The appellants according to the judges tried to ‘repackage a clear violation of the party constitution and that of the Constitution of the Federal Republic of Nigeria as an internal affair of the party’.

Justice Onyemenam further noted that the PDP failed to comply with the constitutional and statutory provisions required before a valid national convention could be held citing failure to properly notify INEC and absence of valid congresses in more than 14 states ahead of the convention.

Compliance with the provisions of the 1999 Constitution, the Electoral Act 2022, and the party’s constitution and guidelines is not only according to the Appeal Court important but also fundamental to democratic governance.

 â€˜Non-compliance with the 1999 Constitution, Electoral Act 2022 and party Constitution and Guidelines are at the heart of democratic governance, and compliance must be strictly enforced in the interest of democracy’ the justices submitted.

The appeal court consequently dismissed the appeal and awarded N2 million in costs against the appellants.
