Gabriel Suswam Loses Bid To Return To Senate As Appeal Court Affirms Emmanuel Udende’s Victory

Former governor of Benue state, Mr. Gabriel Suswam lost his bid to return to the senate on Wednesday as the Court of Appeal, Abuja, affirmed Senator Emmanuel Udende’s victory.
Team@orientactualmags.com learned that the appellate court, in a unanimous decision by a three-member panel, said it was satisfied that Suswam was not the winner of the senate election held in Benue North East senatorial district on February 25, 2023.
The Appeal court submitted that the Benue State National Assembly Election Petitions Tribunal erred by annulling Emmanuel Udende’s victory in September.
The tribunal headed by Justice Ori Zik-Ikeoha had according to the appeal court wrongly evaluated the evidence that was presented before it by parties to the matter and arrived at an erroneous conclusion by finding merit in the petition filed by Suswam.
The appeal court consequently overruled the tribunal, submitting that it found merit in Emmanuel’s appeal.
‘The judgment of the tribunal delivered on 8/9/2023 is hereby set aside.
The return of the Appellant as the winner of the Benue North East senate election that was held on February 25 is hereby affirmed.
Parties are to bear their respective cost’ the appeal court submitted in the ruling that was delivered by Justice Abimbola Osarugue Obaseki .
Suswam, a former member of the House of Representatives, served as governor of Benue state between 2007 and 2015.
He also represented Benue North-East in the senate between 2019 and 2023- Team@orientactualmags.com
