Kano Throne: Aminu Bayero Told To Vacate Palace For Renovation After Favorable Court Ruling

Kano state government insisted on Thursday that  Alhaji Muhammadu Sanusi  remains the Emir  of Kano while also asking Alhaji Aminu Bayero to vacate the  Nasarawa GRA mini palace so as to allow the government carry out planned renovation works.

The state Commissioner of Police  has also been asked to ensure that  Alhaji Aminu Ado Bayero leaves the  Gidan Nassarawa mini palace without delay.

Team@orientactualmags.com learned that the state Attorney General and Commissioner of Justice, Haruna Isa Dederi  , who was accompanied by the Secretary to the State Government, Baffa Bichi  disclosed this while talking to journalists  at the Government House, Kano on Thursday.

Recall that the  Federal High Court , Kano  had earlier in the day  nullified the Kano Emirate Council (Amendment No. 2) Law, 2024, that abolished  four of the five emirates councils in  the state last month and removed all the five emirs, including Aminu Ado-Bayero, who was the Emir of Kano.

Governor Abba Yusuf had  on  May 23 , 2024, signed into law the bill that repealed the State Emirate Council Law 2019 and he had almost immediately had Alhaji Sanusi reappointed as emir of Kano.

A title holder in the Kano emirate council, Aminu Dan’agundi, had however instituted a lawsuit  to oppose the decision taken by the state government  and the judge, Abdullahi Liman, in the  suit number FHC/KN/CS/182/2024, had ordered the state government and the other parties involved to stop the implementation of the new emirate law pending the hearing of the substantive case.

Delivering his ruling on Thursday, June 20, 2024, Justice Liman, who  got to  the court room at exactly 3:08 p.m,  and apologized for coming late , ruled that Alhaji Sanusi’s reappointment  as Kano monarch is null and void as the government had failed to obey the court order restraining it from taking further actions on the new emirate council law.

The state Attorney General and Commissioner of Justice, Haruna Isa Dederi submitted on Thursday that Alhaji  Bayero would be removed from the  mini palace which is a government property as the state government has already concluded arrangements for the general reconstruction and renovation of the property in question including  demolition and reconstruction of the dilapidated wall fence with immediate effect.

‘You will recall that during our last press briefing, we had informed you that we would keep you posted relating to any further development in respect of our emirate cases. Today , 20th June, 2024, the Federal High Court No. 1, Kano had passed its ruling in respect of the case before it.

I have the honour, on behalf of His Excellency, Gov. Abba K. Yusuf and the Kano state Government, to address you once again ,over the lingering litigation arising from the abolishment of the Five (5) emirates and the  deposition of the former emirs. (including the deposed emir of 8 metropolitan local governments)

The Kano state Government acknowledges the ruling by the Federal High Court regarding the Kano Emirates Council (Repeal) Law, 2024 and views same as upholding the rule of law.

By today’s court ruling , it has unequivocally reaffirmed the validity of the law passed by Kano state House of Assembly and assented to by His Excellency, the Executive Governor of Kano state on Thursday 23rd May, 2024 by 5:10pm.

This part of the judgment is very fundamental to the entire matter. Further implications of the ruling are that all actions done by the Government before the emergence of the interim order of the honorable Court, are equally validated. This means that, the abolishment of the Five emirates created in 2019 is validated and the deposition of the Five emirs is also sustained by the Federal High Court.

By implication this means that Muhammadu Sanusi II remains the emir of Kano. The judge also granted our application for the stay of proceedings until the Court of Appeal deals with the appeal before it on jurisdiction.

Happily, the signing of the law and the reinstatement of His Highness, Emir Muhammad Sunusi II were done on 23rd May, 2024 before the emergence of the Interim Order which was served on us on Monday 27th May, 2024’ he said.

Recall that Governor Yusuf had announced the decision to reenthrone Alhaji Lamido Sanusi last month.

‘With the full support of the kingmakers, I have approved the reappointment of Malam Sanusi Lamido’ Governor Abba Yusuf  had gleefully submitted at the Art Chamber of the Government House , Kano .

Recall also  that  Alhaji  Abdulahi  Ganduje, who is currently the APC National Chairman,  had  in his eight years as governor of Kano state did a lot of things that influenced the course of history especially when it comes to chieftaincy matters.

Recall   that in 2019, the House of Assembly had approved the creation of four additional emirate councils, bringing the number of First-Class Emirs in the state to five.

Apart from creating new emirate councils, Alhaji Muhammadu  Lamido Sanusi, a former governor of Central Bank of Nigeria, CBN,  was also removed as Emir of Kano on   March  9 ,2020 .

Alhaji Aminu Ado Bayero, who was then serving as Emir of Bichi , was appointed as the new Emir of Kano.

The new councils created by the Ganduje administration are  Gaya; Karaye, Rano, Bichi Emirate Councils.

Alhaji Lamido Sanusi had  not  only opposed this  but also instituted a lawsuit against the  state government then headed by  Alhaji  Abdulahi Ganduje and the house of assembly  while  Justice A. T. Badamasi of the state high court had also at an instance given an order restraining the  then governor from creating the now defunct emirate councils.

After scaling 3rd reading, the Kano state house of assembly last month passed the Kano Emirates Council law (repeal bill) 2024 into law.

The new bill which was assented to by Governor Abba Yusuf on the same day,  had invalidated the creation of four new Emirate councils in the state.

Recall that a group, the Yan Dangwalen Jihar Kano (the Kano Electorate), had sent a letter to the Kano state House of Assembly which was dated February 5,  2024, seeking a review of the bill creating the Gaya, Rano, Karaye, and Bichi emirate councils.
