Kano Throne: Bayero’s Counsels Withdraw From Representation As Judge Asks Lawyers Not To Grant Interview Until….

As two members of the ruling houses  in Kano continue to lay claim to the Kano throne  which has resulted in court cases  Justice Amina Aliyu  of the Kano state High Court has warned  lawyers involved in the case before her against  granting interview to reporters.

Team@orientactualmags.com learned that Justice Aliyu gave this order on Thursday during the court proceedings.

‘I am giving an order to lawyers not to grant any interview with journalists before and even after my ruling on the respondent stay of proceedings application pending the hearing and determination of the appeal’ the Judge said

The applicants in the case, Attorney General and Commissioner of Justice of Kano state, Speaker  of Kano state House of Assembly, and Kano state House of Assembly,   had through their counsel, Ibrahim Isah-Wangida filed a motion exparte dated May 27.

The applicants are asking the court to restrain the deposed Emir, Aminu Ado Bayero, and  the  dethroned emirs of Bichi, Rano, Gaya, and Karaye from parading themselves as traditional rulers .

The respondents in the lawsuit are Alhaji Aminu Ado Bayero, Alhaji Nasiru Ado Bayero Bichi , Dr Ibrahim Abubakar ll, Alhaji Kabiru Muhammad-Inuwa,  and Alhaji Aliyu Ibrahim-Gaya.

Others are the Inspector General of Police, Directorate of State Security Service,  Nigeria Security and Civil Defence Corps, and  the Nigerian Army.

In the meanwhile, Abdul Muhammed, a Senior Advocate of Nigeria, and other counsels for Alhaji Aminu Ado Bayero  have withdrawn from representation.

During the court proceeding on Thursday, Mr Muhammed said he had an affidavit of fact dated 3 July, attached with a notice of appeal and a motion of stay of proceedings and he urged the court to stay proceedings pending the hearing and determination of the motion at the appeal court.

‘My lord, we were served with the court processes this morning by the applicants.
He sought for an adjournment to enable them respond, but the court refused to grant his prayers.

My lord, I and other counsels representing the first respondent apply for the withdrawal of our legal services and appearances’ he said.

Counsel for the 3rd, 4th and 5th respondents, Hassan Tanko-Kyaure, also filed his application for an extension of time dated 2 July and counter affidavit in response to the originating motion.

He urged the court to set aside the Kano state Emirates Council (Repeal) law 2024, adding that due process was not followed.

Mr Tanko-Kyaure also urged the court to dismiss the applicant’s application demanding to be paid N1 billion.

Counsel for the  plaintiffs , Eyitayo Fatogun, urged the court to disregard the respondent’s affidavit of facts pursuant to order 39, rules 1 and 2 of the court.

‘The motion refers to a proposed notice of appeal not a notice of appeal. It shows that the affidavit of facts is just to delay the proceedings. My lord, the business of today is for the hearing of all pending applications’  he said.

Mr Fatogun also asked  the court to dismiss the third, fourth and fifth respondents’ applications on the issue of Kano Emirate Repeal Law cognizant that it is not before the court.

Justice Amina Adamu-Aliyu  had earlier in her ruling refused to grant the application for the stay of proceedings filed by the respondent.

‘The respondent did not disclose any special fact to warrant any stay of proceedings’ she said.

The judge later  adjourned the matter until July 18 to rule on an application for extension of time, notice of preliminary objection, setting aside ex parte order, joinder application, and  request that she should recuse herself among others-Team@orientactualmags.com  Do you have any information you wish to share with us?
