Justice I. A. Yusuf of the Kwara State High Court,, Ilorin, has ordered the Kwara state chapter of the All Progressives Congress (APC) not to henceforth recognize Alhaji Mustapha Salman Ishowo as state secretary.
Team@orientactualmags.com learned the order was sequel to the motion ex-parte filed by counsel for members of the party in Alanamu Central Ward, Ilorin West Local Government.
It will be recalled that APC members in the ward had not only suspended Ishowo from the party citing anti-party activities but had also taken a legal action and sought a court order to get his wings clipped.
According to the originating summons dated February 16, 2023 and deposed to by one of the three claimants in the matter, Jaji Abdulganiy, on behalf of the party, the ward officials had asked the court to restrain the state chapter of the APC (2nd defendant) from recognizing Isowo as its state secretary.
They had also asked the court to declare that Isowo acting as the secretary of the 2nd defendant in spite of his suspension is ‘ultra vires, illegal, null and void’.
Justice I. A. Yusuf had consequently on March 2, 2023 restrained the state APC from recognizing Isowo as state secretary pending the hearing and determination of the motion on notice.

UPON A MOTION EX-PARTE and supporting affidavit dated March 2, 2023 and filed on the same day.
AND AFTER LISTENING to A. O. Abubakar, Esq learned counsel
for the Claimants/Applicants, moved the motion ex-parte and the
court having considered the application moved, granted same as prayed
IT IS HEREBY ORDERED that parties are to maintain status quo and ensure peace pending the hearing of the motion on notice already filed.
The case is adjourned until March 13, 2023 for hearing of the motion on notice
GIVING AT ILORIN UNDER the seal of the court and hand of the presiding Judge on March 2, 2023’ .
APC members in Alanamu ward had since demanded compliance with the court order.
Counsel for the Claimants/Applicants, I.0. Jimoh Esq, a principal partner at Olasehinde J. Adeseko & Co, in a statement made available to Team@orientactualmags.com noted that rule of law is supreme, adding that, ‘being the position of the law, the Order of the Court must be obeyed’
‘We hereby bring to your attention, the Order of the Court made and dated March 2, 2023 restraining the Defendant/ Respondent from parading himself as Secretary of the 2nd Defendant respondent; Kwara State Chapter of the APC pending the hearing and determination of the Motion on Notice.
It is equally contained in the Order that the 2nd Defendant is restrained from further recognizing the Defendant/Respondent as its secretary in Kwara pending the hearing and Determination of motion on notice.
