Counsels for former Governor of Osun state, Alhaji Adegboyega Oyetola, and his party; All Progressives Congress made closing arguments at the Governorship Election Petition Tribunal hearing in Osogbo on Saturday.
Oyetola and the APC had made a petition available to the tribunal questioning the decision of the Independent National Electoral Commission, INEC to announce Governor Ademola Adeleke of the PDP as winner of the gubernatorial election held in the state on July 16 this year.
Team@orientactualmags.com learned the tribunal also during Saturday’s hearing admitted into evidence original copies of Form CF001 and all its attachments that were submitted to INEC by Adeleke ahead of the 2018 governorship election.
The documents presented to the tribunal by INEC through Joan Arabs, a Deputy Director at the commission, after counsel for the petitioners, Mr Lateef Fagbemi, SAN, had assessed them, were admitted into evidence.
Earlier, counsel for INEC, the 1st respondent in the matter, Mr Henry Akunebo, had informed the tribunal that an original file of Adeleke’s GCE results, testimonial as contained in Form CF001 had been made available by his client in compliance with the order of the Tribunal.
Counsel for Adeleke, the second respondent in the matter, Mr Niyi Owolade, and that of the PDP, the 3rd respondent, Dr Alex Izinyon, SAN, had submitted that they had assessed the original copies brought by the 1st respondent, noting that the documents were more legible than the ones presented on Thursday.
After assessing the documents, Mr Lateef Fagbemi, SAN, who represented the petitioners, said they were legible enough and applied to tender them before the tribunal.
Counsel for the respondents however opposed tendering of the documents but noted that they will reserve their argument until the final written address stage.
Izinyon also said the entire documents and its attachment could not be admitted into evidence, since only two pages were said to be illegible, out of the ones previously made available by INEC.
Fagbemi however argued that the entire documents should be admitted since the copies earlier made available by INEC had not been admitted into evidence by the tribunal.
The tribunal eventually admitted all the original documents made available by INEC into evidence and tagged them as exhibit ‘FILE D.’
Fagbemi also informed the tribunal that counsels for the petitioners had made closing arguments.
