ADC: Supreme Court Overrules Appeal Court, Says Status Quo Order Unnecessary…Atiku Cautions Against Complacency
The Supreme Court on Thursday took a definitive decision on the intraparty conflict in the ADC by overruling the Court of Appeal’s status quo order which the Independent National Electoral Commission (INEC) had cited in derecognizing the National Working Committee of the party headed by former Senate President, Mr. David Mark.
Team@orientactactualmags.com learned that five justices, who are members of the panel, in a unanimous decision ordered parties to the dispute to return to the Federal High Court for the suit filed by Mr Nafiu Bala Gombe while directing an accelerated hearing.
The panel submitted through Justice Mohammed Garba that the Court of Appeal had no business making a preservative order in respect of a case that was pending before the trial court, having determined the interlocutory appeal brought before it by Mr David Mark against the September 4 interlocutory decision of Justice Emeka Nwite of the Federal High Court.
The apex court consequently ordered parties to the dispute to return to the Federal High court for the continuation of the hearing of the case.
Recall that Mr Nafiu Bala had on September 2, 2025, filed a suit seeking to be recognized as National Chairman of ADC.
In the meanwhile, former Vice President Atiku Abubakar reacted to the Supreme Court ruling on Thursday calling it a welcome development.
He however cautioned party members against complacency.
The former Vice President, who noted that ‘this victory belongs to Nigerians’, however said it should not be mistaken for final victory.
‘Even as we welcome the Supreme Court’s firm affirmation of David Mark and the leadership of our great party, the African Democratic Congress, let no one be lulled into complacency. The road ahead remains long in our cause to take back and rescue our country.
This victory belongs to Nigerians, the courageous millions who refuse to surrender their future. We thank them, and we urge them to remain steadfast, because the struggle is far from over.
