Have Sex With Your Wife Without Her Consent And Get Ready To Go To Jail, Lagos Govt Tells Married Men
Marriage does not mean that a person has been given permanent or automatic permission for sex as Lagos State government on Tuesday warned that non-consensual sex in marriage can make married men face prosecution.
Team@orientactualmags.com learned that the Director of Public Prosecutions, DPP, Lagos State Ministry of Justice, Dr Babajide Martins said this while giving his speech during the event held by the Domestic and Sexual Violence Agency, DSVA, to mark the commencement of the state’s Domestic and Sexual Violence Awareness Month.
Responding to a question asking if a married woman can seek legal redress if her husband commits spousal rape he noted that while the federal law does not recognise sex without consent as marital rape, Lagos State law however contains provisions under which a man can be prosecuted if found culpable.
‘Any man who feels that because he has paid his wife’s dowry, nobody can challenge him for domestic violence, the wife should report such a man to the Domestic and Sexual Violence Agency.
Under Lagos State criminal law, a man cannot be accused of raping his wife if they are together and are on good terms.
However, once there is an issue between them and the wife refuses to have sex with him, the husband cannot force her. If the husband forces her and the wife reports him, we will not charge him for rape, but for sexual assault by penetration, and the punishment is life imprisonment’ he said.
The DPP urged women who are domestic or sexual violence victims to report such incidents to the Domestic and Sexual Violence Agency in order to take necessary actions –Team@orientactualmags.com Do you have any information you wish to share with us?
