Fagbemi Gave ‘Biased Advice’, We’ll Participate In Tomorrow’s LG Elections-Osun APP
Reactions have continued to trail the advice given by the Attorney General and Minister for Justice, Mr. Lateef Fagbemi SAN in respect of the court ruling on the outcome of the local government elections conducted by the Osun State Independent Electoral Commission (OSIEC) on October 15, 2022, and its connection with the local government elections scheduled to hold in the state tomorrow.
The state APP on Friday accused the minister of giving a biased advice while expressing readiness to participate in tomorrow’s local government elections.
Hon Odesola Oluseye Títus, who is the state Chairman of the Action Peoples Party (APP), said this during the press conference he presided over in Osogbo on Friday.
He asserted that being a partaker in the last local government elections and the sebsequent election cases, the leaders of the party are well-positioned to have an informed opinion on the issue.
‘The Action Peoples Party in Osun State today, 21st of February, 2025, frowns at the unsavoury and fatally- biased communication purportedly emanating from the office of the Attorney General of the Federation.
As an interested party in the botched October 15, 2022, local government elections in Osun State, it is imperative to state that the purported stance of Mr Lateef Fagbemi, the Attorney General of the Federation was in bad taste, utterly disrespectful to the laws of the land and it is a calculated fertile ground for avoidable violence in our dear state.
For us in the APP, a partner in the democratic trajectory in Nigeria and particularly, Osun State, we found it ludicrous to believe that such a naked biased memo would come from the AGF, Fagbemi, knowing full well that there is a valid judgment of the same court of appeal affirming the nullification of the October 15, 2022 local government elections in Osun State. Recall that the election had earlier been annulled by the Osogbo Federal High Court, on 30th of November, 2022, for contravening the electoral laws.
It is ridiculous to say the least that a law officer of the Federation, would deliberately feign ignorance of a subsisting judgment of the court of the land by cherry picking the side of another judgment he deemed suitable for his tailored narrative.
In a sane clime, an Attorney General of the Federation should be abreast of the minutest of court pronouncements in the Federation and should be addressed holistically if and when the need arises. This the AGF has failed and it is appalling in the mildest of expression
As an active participant in both the collapsed October 15 , 2022, and the February 22, 2025, and after due consultations with our legal department and members of our party, we are left with no doubt that the scheduled local government elections slated for February 22, 2025, should proceed.
The Attorney General of the Federation is not a bigger entity than the courts in Nigeria. He is advised to test his opinion in the court of law according to the constitution of Nigeria which established the office of the Attorney General, which is world apart to constitutional courts.
I want to reiterate that our great party, the Action Peoples Party will participate in Saturday’s election.
