We Can’t Prosecute Tinubu Without  Just Cause-IGP Alkali Usman

We Can’t Prosecute Tinubu Without  Just Cause-IGP Alkali Usman

The nation’s   police chief,  Alkali Baba Usman, has said the APC presidential candidate, Asiwaju Bola Ahmed Tinubu, cannot be prosecuted without just cause noting that the former Lagos state governor had   no pending petitions or criminal matters that were of interest to the Police.

Team@orientactualmags.com learned the Inspector General of Police  said this  in a counter affidavit filed at the Federal High Court , Abuja by his counsel, Mr. Wisdom Madaki.

Madaki also added that  Tinubu was not under surveillance  .

In the counter affidavit to the suit instituted by a Civil Group seeking an order of mandamus to compel the IGP to arrest and prosecute Tinubu for perjury and certificate forgery, the Police Chief submitted that the Police have no power to prosecute Tinubu without  just cause.

The two petitions against Tinubu, he noted,  centered on allegations that the Supreme Court had delivered ruling with regard to them  in 2002 sequel to the lawsuit instituted by the late human rights activist,  Chief Gani Fawehinmi.

The affidavit noted that since the alleged perjury and certificate forgery had been resolved by the apex court, there was no need for the police to reopen the matter.

The IGP said  the police did not need any court order to make arrests or prosecute having  derived its powers from the constitution and statutes.

He prayed the court to dismiss the suit brought against him and the Nigeria Police Force for want of merit and jurisdiction.

Counsel for the Civil group, Mr Eme Kalu Ekpu told Justice Inyang Edem Ekwo on Tuesday that the counter affidavit of the  police had just been served on him and that he needed time to take a look at it and reply to it formally.

Ekpu asked Justice Ekwo to grant him a short adjournment to enable him respond to the counter affidavit properly.

Justice Ekwo  later granted the request and fixed January 19, 2023, for hearing of the suit- Team@orientactualmags.com
